General Terms
Welcome to RumbleCard.com, the website (the "Site") of Rumble Card. This site is provided by AgileMark as a service to our customers. Please review the following basic rules that govern your use of the Site (the “Agreement”). Please note that your use of this Site constitutes your unconditional agreement to follow and be bound by these Terms and Conditions without modification. If for any reason you do not agree with the Terms and Conditions as stated below, please do not access this site.. Although you may “bookmark” a particular portion of this Site and thereby bypass this Agreement, your use of this Site still binds you to these Policies. Rumble Card reserves the right to update or modify these Policies, effective immediately upon posting on the site, without prior notice to you. Each time you use this site, you should review these Policies, as updates may have occurred.
Indemnity
You agree to indemnify and hold Rumble Card, its parent and affiliate companies, and their respective officers, harmless from any and all claims, including reasonable attorneys' fees, arising out of your breach of any of these Terms and Conditions or in connection with your use of this site.

Rumble Card makes certain copyrighted art works, graphics, and text found in the Print Builder gallery and templates
available to you for use with the Site. Rumble Card permits you to use this copyrighted material when
purchasing printed materials from this site. Any other reproduction or use of these copyrighted materials is prohibited.
Copyright
laws may pertain to the content you submit to Rumble Card.
Unlicensed or misuse of copyrighted material from books, magazines,
newspapers, photographs, web content, writers, artists, composers,
publishers, and other authors is strictly prohibited.
Rumble Card will not assume the responsibility of checking the content of
its client's submitted materials for copyright violations. Therefore,
Rumble Card will not be held accountable for any illegal use of
copyrighted material by its clients.
Customer Content for Printing
You, as the buyer, have responsibility for the content and infromation
(including but not limited to text, graphics, information and messages) submitted for printing.
You agree to abide by all rules and regulations pertaining to
on-line decency and appropriate and acceptable content. This means that
you agree to the following with regards to any product coming from
Rumble Card:
You will not upload, post or send any content through the Rumble Card
service containing child pornography; material that threatens to kidnap or injure anyone,
threatens to damage the reputation of anyone or harm their personal
property, threatens to accuse anyone of a crime, threatens to announce
that a person has violated law/s of the United States, or threatens
blackmail; encourages or suggests forcible resistance to any law of the
United States, insurrection, or treason; includes fraudulent, libelous
or hurtful remarks directed at any other person or business; or
infringes upon the intellectual property rights of Rumble Card or
any other party.
Rumble Card does not control, nor guarantee the accuracy, legitimacy, and/or
quality of any information or content posted by our customers. Rumble Card will not be held liable under
any conditions or circumstances
for any information, content or material that you may find indecent or
offensive.
Rumble Card provides services and products only
for your personal and/or business use and you agree to refrain from using such services
and products, as well as messages or correspondences for any
unauthorized purposes including but not limited to spam, or any other form of prohibited solicitation.
You must have a registered account to place an order. If you do not have an account at the time you place an order then
a new account will be created for you. Protecting your password and controlling access to your
account is your responsibility. Rumble Card will not be
held responsible for any password or access problems. Furthermore, all
orders, actions, etc., placed through your registered account are your
responsibility and not the responsibility of Rumble Card.
Rumble Card reserves the right to remove or refuse any content or
information that violates the Terms and Conditions agreement or may
otherwise be considered unlawful or objectionable.
In addition, you agree that content and or information
obtained by Rumble Card may be kept and disclosed if Rumble Card is required to do so by law,
or if Rumble Card believes,
in good faith, that it is necessary to disclose such content in order
to comply with any legal proceeding or processes; uphold or enforce the
terms of our services; respond to any claims that the content or
information is or may be in violation of the rights of another party; or
that the content/information is necessary to protect the rights or
property of the public or Rumble Card in any way.
Submission of Artwork or Graphics
A resolution of 300 dpi is suggested for all artwork and
images. Artwork with a resolution less than 300 dpi may be noticeably degraded and poor quality when printed.
All artwork and images should be submitted in CMYK color format. Artworks and images submitted in other color formats
will either be rejected or will be converted with a possible shift in color. Final artwork and graphics for printing must contain 1/8 inch bleed
area on all sides, and no crucial graphics or text should extend beyond the safety box that is 1/8 inch inside the final trim box.
Color Matching
Rumble Card cannot be held responsible for matching colors or ink
densities on screen proofs approved by customers. Screen proofs can be
used to help display layout, text
accuracy, and image placement and proportion, but not color or density.
Rumble Card
will make every effort to match the gradient density of each
color, however, we cannot be held responsible for the final appearance
of a color. The appearance of printed colors may be affected by UV
coating, therefore, Rumble Card cannot be held responsible for
final color appearance of UV-coated product/s.
Returns and Refunds
Customer orders have no re-sale value. Therefore, ALL SALES ARE FINAL.
If the error is verifiably due to Rumble Card, we will re-print
the order at our cost. Any defect/s discovered in your shipment must be
reported to Rumble Card within 10 days of your order's receipt.
Shipping and Delivery
Rumble Card will always strive to avoid any delays in production
or shipping, however, we will not be held responsible for any
consequences or damages due to delayed production or delivery. Our
shipment and delivery dates are based upon estimates provided by our
shipment suppliers. Rumble Card will not be responsible for delays
in shipments due to shipping company delays, international customs
issues, weather conditions or any other circumstances beyond our
control. Rumble Card will strive to ensure that all delivery
schedules are met in a timely manner. There will be an additional
charge if any changes to the shipping address must be made after the
order is placed.
Shipping Errors
In order to file a lost or damaged claim the following must apply:
Claims
can only be placed within 30 days from package shipment. Rumble Card
cannot be held responsible for shipping errors, delays or lost
or damaged products due to 3rd party errors.
In the case that a
customer supplies the wrong address causing a package not to be
delivered on time, Rumble Card will reship the package (to the
corrected address) with an additional shipping fee for the re-shipment.
LIMITATIONS & LIABILITY:
OUR LIABILITY IS LIMITED TO OUR SELLING PRICE OF AN ITEM OR SERVUCE AND SHALL
NOT INCLUDE ANY CONSEQUENTIAL DAMAGES OR DAMAGES FOR PROFIT LOST.
WE HAVE THE RIGHT TO HOLD CUSTOMER PROPERTY (a lien) AS SECURITY FOR
UNPAID BILLS.
Rumble Card reserves the right to refuse service to any party for any reason it deems fit.
Observed Holidays
The following holidays are observed as business holidays.
All operations as well as Customer Service are closed on these days.
Holidays are excluded from Turnaround and Shipping Time.
New Year's Day
Memorial Day
Independence Day
Labor Day
Thanksgiving Day, and Friday following Thanksgiving
Christmas Day
Mailing Services
We are not responsible for lost or non-delivered mail. The U.S. Postal Service does not track mail. Our responsibilities end when the U.S. Postal Service accepts your mailing from us. We will have a proof of mailing statement (3602-R for standard class, 3602-NP for the Non-Profit and 3600 for first class mail.) that can be faxed to you upon request. First Class mail takes 1 - 5 days (average) to reach its destination. Standard Class and Non Profit mail take 7 - 20 days (average) to reach its destination. The U.S. Postal Service will not give a refund on postage for non-delivered mail. We are not responsible nor do we guarantee a response to your mailing. Your results may vary.
We understand that your list is privileged and confidential. It will not be used or sold for any purposes other than your mailing. Upon request we may archive your list but will not be held responsible of system failure. You should always have a copy of your list with you.
In the event of a mistake or error, we will only accept liability up
to the cost of goods and services provided. By using our services we
will not accept liability for any loss of revenue, business or implied
damages.
Mailing List Purchases
You agree to specific usage terms and prior to licensing the Information or Information Services at time of transaction.
You are receiving only a limited license to use the Information for Your own internal business or personal use, or for
third parties who have expressed agreement to the attached term & conditions.
NEITHER RUMBLE CARD, USADATA NOR ANY INFORMATION PROVIDER MAKES ANY WARRANTY, EXPRESS OR IMPLIED,
AS TO THE COMPREHENSIVENESS, COMPLETENESS, ACCURACY OR ADEQUACY OF THE INFORMATION OR ANY INFORMATION CONTAINED THEREIN.
THE INFORMATION IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND FROM EITHER USADATA OR ANY INFORMATION PROVIDER.
FURTHER, NEITHER RUMBLE CARD, USADATA NOR ANY INFORMATION PROVIDER WARRANTS, GUARANTEES OR MAKES ANY REPRESENTATIONS
REGARDING THE USE, OR THE RESULTS OF THE USE, OF THE INFORMATION IN TERMS OF ITS ACCURACY, RELIABILITY,
CURRENTNESS OR FITNESS FOR A PARTICULAR USE. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE
INFORMATION IS ASSUMED BY LICENSEE OR USER.
You hereby waive any right to claim liability on the part of Rumble Card or any information provider based
upon inaccuracy of the Information. Licensee expressly agrees that the following limitation on remedies is an
essential part of the consideration bargained for under this Agreement. The entire liability of Rumble Card and
any information provider, and Licensee’s exclusive remedy as to the Information shall be, at Rumble Card’s or
information provider’s option, either (a) return of the subscription fees or document charges, or
(b) replacement of the
Information or portion thereof. Rumble Card agrees to indemnify Licensee for any loss incurred based on a third
party claim arising out of any alleged breach of a copyright, trademark, patent, trade secret or any intellectual
property right resulting from the licensed use of the Information by Licensee.
The above are the only warranties of any kind. Licensee hereby waives, and Rumble Card and the information
providers hereby disclaim, any other warranty, either express or implied, including but not limited to
the implied warranties of merchantability and fitness for a particular purpose, on the Information. No
oral or written information or advice given by Rumble Card, any of its employees or other person shall create
a warranty or in any way increase the scope of this warranty and Licensee may not rely on any such information or advice.
